1. Agreement to Terms

By accessing or using the HP Construction Services website located at hpconstructiondc.com (the “Site”), including the AI estimating tool, contact forms, and any content or services offered through the Site, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, users, and others who access or use the Site. HP Construction Services (“Company,” “we,” “us,” or “our”) reserves the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.

2. AI Estimating Tool — Important Limitations

You acknowledge and agree that:

• AI-generated estimates are approximate ranges based on general market data and DC construction benchmarks. Actual project costs may be significantly higher or lower based on site-specific conditions, material availability, labor costs, and scope of work.
• No binding contract for construction services exists until a written, signed proposal or contract is executed by both you and an authorized representative of HP Construction Services.
• Estimates do not account for conditions that are concealed, unknown, or not described by the user, including but not limited to structural issues, hazardous materials (lead, asbestos, mold), code violations, utility conditions, or soil conditions.
• Permit fees, engineering costs, design fees, and other soft costs are estimates only. Actual DCRA permit fees and processing times are subject to change and must be verified directly with the DC Department of Consumer and Regulatory Affairs.
• Historic district determinations are provided for informational purposes based on publicly available GIS data. You should verify historic district status with the DC Historic Preservation Office before relying on it for project planning.

3. No Contractor-Client Relationship

Use of this Site, the AI estimating tool, or the submission of a contact form does not create a contractor-client relationship, agency relationship, or any other professional relationship between you and HP Construction Services. No such relationship is formed until a written contract is signed by both parties.

4. Contractor Licensing & Insurance

HP Construction Services holds all required licenses to operate as a general contractor in the District of Columbia. Licensing information is available through the DC Department of Consumer and Regulatory Affairs at dcra.dc.gov. We carry general liability insurance and workers’ compensation insurance as required by DC law. Certificates of insurance are available upon request.

5. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Submit false, misleading, or fraudulent information through any form or tool on the Site.
• Attempt to reverse-engineer, scrape, or interfere with the AI estimating tool or any other functionality of the Site.
• Use the Site to transmit spam, malware, or any harmful content.

6. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of HP Construction Services or its content suppliers and is protected by applicable US and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our express written permission.

7. Third-Party Services

This Site uses third-party services including Anthropic (AI), Vercel (hosting), and Resend (email delivery). Your use of features powered by these services is also subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INCLUDING AI-GENERATED ESTIMATES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. HP CONSTRUCTION SERVICES MAKES NO WARRANTIES REGARDING ACCURACY, COMPLETENESS, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY CONTENT ON THIS SITE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HP CONSTRUCTION SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ANY AI-GENERATED ESTIMATE OR OTHER CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the courts of the District of Columbia.
